Terms and Conditions

These terms and conditions apply to items ordered by Internet from the Beds Direct 247 website.

Please take time to read these terms and conditions it is important for both of us that you understand our contractual relationship relating to your use of the website. Please make sure that you have read these terms and conditions before completing your transaction with us. We will not allow you to purchase any products from the website unless you have confirmed that you have read these terms.

You undertake to us that the details you give to us while using the website are correct in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the product or service.

If there are any changes to the details supplied to us by you it is your responsibility to inform Beds Direct 247 via our web form or by contacting our Customer Services as soon as possible.

Order acknowledgement

Your order will be acknowledged via email, if you enter a correct email address. Acceptance of the order will take place on clearance of payment.

Payment

Payment may be made by any of the methods indicated on our website and will be debited when we receive your order.

You will be charged the current price for buying goods from our website at the date you place your order. All prices are displayed on our website and are inclusive of VAT, where applicable, at the prevailing rate. We reserve the right to amend prices if there is a change in the rate of VAT. Standard Delivery (28 working days) is included in the price for UK locations only. Prices for European and International addresses can be found on our website under the Customer Service section. We do our best to make sure that prices are correctly shown but very occasionally an error may occur.

We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the technology that is required in operating the website there may be times when obvious errors occur. For example, very occasionally, this may result in a price, or product or other detail displayed or presented on the website being incorrect. In this case we reserve the right to cancel that contract, but this of course will be without any liability to you. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the goods at the correct price.

Internet Prices & Offers relate only to Internet transactions and may not be available in store.  To take advantage of our Internet prices in our store please notify one of our sales staff before your purchase.

Delivery

Goods are delivered by Carrier or our in-house Delivery.

A signature will be required to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that you or the person to whom the order is addressed, has received the delivery.

Where a delivery date has been agreed with our carrier but the Buyer is not present to receive the delivery, the Seller reserves the right to charge the Buyer a minimum of £25 to cover the cost of the failed delivery.

If no-one is available to sign and receive the product, a card will be left informing the recipient of the next available options. Orders will be processed only after payment has cleared.

Where purchasing a Next Day Delivery Mattress, please ensure your order has been placed before 12PM (Midday) of that day. This will ensure you recieve your mattress within 24 hours.  If your order is after 12PM (Midday), then no guarantees will be made on delivering your mattress within 24 hours and the delivery timescale will roll over into a 48 hour delivery time scale.

Our Short Delivery term in Express Delivery Items, means we look to achieve your delivery within 1 - 5 working days, this is variable on stock availability and geographical area.

On Next Day Delivery & Express Delivery Items the delivery crew will deliver your item to the first door of your house (should you live in a block of flats then delivery will be made to the first door of the building). You will be given ample time to check your goods carefully for any visible damage before signing for them. This is a one man delivery service and the goods will be left in the hallway/front door as the driver is not able to carry the goods to the bedroom. Drivers are unable to make telephone calls to advise time of delivery.

Please note that it is your responsibility to sign for the delivery as received, should your packaging be damaged, please mark this on the delivery note, failure to do so may result in any future claim for replacements due to damage being invalidated

Old Bed & Mattress Collection

When using our old bed or mattress collection please keep old Divan Bases & Mattresses dry and accessible for our drivers. The Drivers will collect like for like items in terms of quantity & size of mattress, unless pre-agreed by one of our sales representatives. Please ensure that when we are collecting divans or bed frames that all item's are dis-assmebled and ready for immediate collection.

Cancellation

If, for any reason, you are unhappy with the item/s you have ordered you have the right to cancel.

If you wish to cancel before the items are dispatched you are asked to contact us, by e-mail This e-mail address is being protected from spambots. You need JavaScript enabled to view it or via our web form in the contact us section as soon as is practicably possible.

If the order has been shipped you will need to return the order to us. You still have the right to cancel your order under the United Kingdom's Distance Selling Regulations, for a full refund. Once you have cancelled your order, the goods should be returned to the same address, in their original condition, within 7 days of receipt. The item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.

Price Beater

Our Price Beater Policy is in terms of if you find one of our models advertised online at a lower price elsewhere, simply contact us by e-mail or telephone with details of the retailer and the exact product specifications and price. Upon receipt we'll review your request and do our utmost to respond with our best offer within 2 working days.

There are certain points that need to be adhered to when using our Price Beater Policy:

  • The Competitor's product must be identical in brand, model, size and options etc.
  • The competitor's product must be clearly advertised and able to purchase online now.
  • The Competitor's price should be inclusive of UK mainland delivery & VAT.
  • You're in a position to place your order within 5 working days.
  • The Price Beater Offer refers to products available on our website only.
  • You are only able to activate the Price Beater on or before purchase of product, not at any other time afterwards the transaction.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

All matters concerning and incidental to any offer or agreement for the purchase and sale of goods from our website shall be in English and construed and governed according to English law and the English courts shall have jurisdiction in all such matters.

Returns

If you are not completely satisfied with your purchase, please email us explaining why you wish to return or exchange the item. You will then receive an email within 48 hours with a unique Returns Authorisation Code and instructions on how to proceed. Please do not return the item until you have received this email and your Returns Authorisation Code from us.

Please note that items cannot be returned unless they are in their original condition, and within 7 days of the original purchase date. Please include the original packaging and any enclosed documentation in the return. Where items are received in their original condition, and in accordance with the above, a refund will be issued on receipt. If the item is not returned in its original condition and is unsaleable we will be unable to authorise a refund, and the item will be returned to you.

The Buyer will be responsible for returning the Products to the Supplier at the Buyer's own cost.Once the Seller has been notified of the cancelling of the Contract, the Seller will refund or re-credit the Buyer within 30 days for any sum that has been paid or debited from the Buyer's credit card for the Products.

The item is your responsibility until it reaches us. For your own protection, we therefore recommend that you return the goods using a delivery service that insures the goods for the value of the goods. This does not affect your statutory rights.

*Note: All products are checked thorougly before dispatch. Therefore packaging must be intact if returned, for obvious reasons of mattress hygiene.

Faulty or wrong item

If your goods have been delivered and are defective or damaged, please read this procedure carefully.

  1. 1.The Buyer must provide written notice of the defect or damage within 7 days of the Buyer receiving the Product(s) from the Seller. The written notice must be in the form of an e-mail and sent to This e-mail address is being protected from spambots. You need JavaScript enabled to view it . In the email, the Buyer must include the following details;
    1. Order Identification Number
    2. Name
    3. Address
    4. Goods Ordered
    5. Problem(s) with Goods
    6. Proposed Solution (i.e) Missing Parts Required
  2. The Buyer must not use the defected goods unless instructed in writing by the Seller to do so.
  3. The Seller will contact the Buyer within 2 working days to discuss the problems and provide a solution to rectify the situation.
  4. The seller will not be liable to replace any products should they fall under the following categories:
    1. The Buyer makes further use of such Products without the Seller's consent after notifying the Seller of the defect/damage.
    2. The defect arises as a result of fair wear and tear, wilful damage, negligence, misuse, abnormal working conditions or failure to follow our oral or written instructions as to the storage of use of the Products.
    3. The Buyer alters or repairs such Products without our written consent; or The Buyer has not paid the Contract price for the Products by the Payment date.
  5. Providing the Buyer does not fall within any of these categories, the Seller reserves the right to either; Repair or replace such Products (or the defective part) free of charge; or Refund the price of such Products (or a proportionate part of the price) provided that the Buyer allows for the Seller to collect the Products or the part of the Products that are defective.
  6. Should replacement Parts be requested by the Buyer, the time in which the replacement parts can be delivered to the Buyer will depend on the lead time stated by the relevant manufacturers. The Seller will relay this information to the Buyer but will take no responsibility should this time be longer.
  7. Should a refund be offered to the Buyer, the money will be re-credited back onto the same credit/debit card the Buyer used to make the original purchase. This will be done within 7 days of the Seller receiving the goods back into their warehouse

Distance Selling Regulations

you have the right to cancel your order for any item purchased from Beds Direct for a full refund. This does not apply to items that cannot be returned for hygiene reasons, and have been unsealed. Order cancellations must be made in writing, quoting your order number, within 7 days of delivery of your item(s), and can be sent by e-mail , or by post to the address above. Once you have cancelled your order, the goods should be returned to the same address, in their original condition, within 10 days of receipt. The item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.

Return Postage

If you are returning an item to us for a refund or an exchange then the cost of returning the item to us is your responsibility.

If the item you received is faulty or is not what you originally ordered, please contact us via our contact form or e-mail our Customer Service department - quoting your order number, your name and address, and details of the product. You will then be advised on how to proceed with the return.
